Heard the learned Senior counsel, Sri. K. Shashi Kiran Shetty, appearing for the petitioners.
Learned AGA is directed to accept notice for the respondents.
Learned counsel appearing for the petitioners is directed to serve a copy of the petition papers upon the learned AGA.
Learned Senior counsel appearing for the petitioners submits that in an identical matter, in W.P.No.22429/2022, this Court by its order dated 15.11.2022, has granted an interim order and therefore, seeks an interim order of stay of the kind that is granted in the aforesaid writ petition.
The order dated 15.11.2022, in W.P.No.22429/2022 passed by this Court, reads as follows:
“Learned AGA is directed to accept notice for the respondents.
Learned Senior Counsel Sri K.Shashi Kiran Shetty appearing for the petitioner submits that the name of the petitioner which was enlisted under Category II-B is now taken out and placed in GM on certain premise that runs counter to the judgment of the Hon’ble Apex Court in the case of Surinder Singh Vs. Punjab State Electricity Board & and others reported in (2014) 15 SCC 767, which is subsequently followed by this Court in W.P.No.24115/2018 & connected matter.
Therefore, the act of the respondents prima-facie would run counter to the aforesaid judgments. The candidature of the petitioner shall be processed as one belonging to Category II-B, which would remain subject to the result of the present petition.
List the matter on 09.12.2022.”
Therefore, there shall be an interim order of stay of all further proceedings pursuant to the provisional select list dated 18.11.2022, till the next date of hearing.
